A Cypress homeowner experienced an AC drain pan overflow. Mitigation was completed before the insurer’s adjuster arrived. The insurer then issued a payment letter citing a “$10,000 limit for water damage for claims such as yours, including emergency water removal.” Their own estimate valued the loss at $14,117.58. After the deductible and depreciation, the check was $9,117.58.
The homeowners sought a second opinion. After reviewing the policy, Versa disagreed with the limitation as applied and took the claim on. Within days of receiving Versa’s letter of representation, the insurer offered to pay out the remainder of the $10,000 limit — $882.42 in new money — described as a “concession in good faith.”
Versa declined. A full proof of loss was submitted at $61,381.75. By that point the insurer had two separate opportunities to apply their own policy language correctly. The adjuster who handled the original assessment carried the title of Senior Complex Claims Adjuster and had held an active license for seven years.
The insurer settled at the full proof of loss amount with no depreciation holdback, on a confidential basis.
The provision cited as a “water damage limit” was a cosmetic and aesthetic damage limitation applicable only to floor damage defined as “chips, scratches, cracks, dents, or any other damage to less than 5% of the total floor surface area that does not prevent typical use of the floor.” The damaged flooring removed during mitigation was structural, not cosmetic, and far exceeded 5% of the total floor area. Versa explained the policy’s own language back to the insurer.

Homeowners noticed wet wood flooring in their kitchen and filed a claim. The insurer’s adjuster wrote an estimate of $61,612.64 based on what was visually apparent at inspection. The insurer also provided the homeowners with a written guidance document issued specifically for water losses, outlining their next steps.
That document told the homeowners to turn off the water, contact a contractor if needed, and take photos. It instructed them to “hold off” on permanent repairs until covered damages were fully evaluated. It did not instruct them to remove wet materials. The homeowners followed the insurer’s guidance.
A contractor they called to bid the repair work recognized signs of damage in areas the adjuster had not seen and recommended they contact Versa. Versa worked with an industrial hygienist to assess and document the full scope of the loss, including material removal and microbial remediation required as a direct result of the slab leak.
A full loss package was submitted for $282,119.21. The insurer assigned a new adjuster, who met Versa on site. They spent four hours walking the property room by room and reviewing the documentation. The claim settled at $259,039.66.
